Terms of sale

These terms apply to any personalized song order placed with Ma Chanson Perso ("the Provider") by a consumer client ("the Client").

1. Service

The Provider creates personalized songs: custom lyric writing, creation of the music and voice using artificial intelligence tools under the Provider's direction, mixing, mastering and delivery of digital files (MP3 and, depending on the plan, WAV, lyrics PDF, photo slideshow video, instrumental version and, as an add-on, karaoke video).

2. Ordering

The Client places an order via the site's form, choosing a package and add-ons. The order becomes firm upon receipt of payment. The Client warrants the accuracy of the information provided and declares having the necessary permissions for the materials transmitted (texts, photos).

3. Pricing and payment

Current prices are displayed on the Pricing page, in euros, all taxes included. The order form shows the total to pay based on the package and options chosen. Payment is made online by PayPal (card or PayPal account), at the end of the form. PayPal payments take place on the PayPal website: the Provider has no access to the Client's banking data. If the request changes, the Provider confirms the amount to pay before work begins. Promotional codes are valid under the announced conditions.

Seasonal promotions: for Christmas (15 November to 31 December) and Valentine's Day (27 January to 14 February), a 10% discount on the Premium plan and a 20% discount on the Prestige plan is applied automatically in the order total. It applies only to the price of the plan, not to add-ons. It also applies to the purchase of a Premium or Prestige gift card, which keeps its full value. It cannot be combined with a gift card used to pay for an order, or with the DUOSONG offer. Dates and rates may change from one year to the next: the discount that applies is the one displayed when the order is placed.

Welcome code: a personal code (MERCI-XXXX-XXXX) can be obtained by leaving an e-mail address on the site. It gives 10% off the price of the plan, excluding add-ons, once, until the date stated in the e-mail that contains it. Only one code is given per e-mail address. It cannot be combined with a gift card, the DUOSONG offer or a seasonal promotion: when several discounts are possible, the best one applies automatically and the welcome code can then still be used later, within its validity period.

4. Delivery times

Indicative delivery times are 72 h (Essential), 48 h (Premium) and 48 h with priority handling (Prestige), counted from receipt of payment and of all necessary information (photos included for the slideshow video). The slideshow video included in the Prestige plan is limited to 10 photos. Beyond that, a supplement of €9.90 applies for each extra block of 5 photos, as for the slideshow video add-on (10 photos included). The 24 h express option is subject to availability. A reasonable delay cannot give rise to cancellation or compensation as long as delivery occurs before the event date communicated by the Client. If the desired delivery date is closer than the delivery time of the chosen plan, the express option is automatically added to the order.

5. Revisions

Each plan includes the number of revision rounds indicated on the Pricing page: 1 round with Essential, 2 with Premium and 5 at most with Prestige. Revisions cover adjustments (words, phrasing, tempo, mixing) and not a complete rewrite from a different brief, which would constitute a new order.

6. Right of withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications and clearly personalized, nor to digital content supplied before the end of the withdrawal period with the consumer's express agreement. By confirming the order, the Client accepts the immediate start of the service and expressly waives the right of withdrawal.

7. Usage rights

The Client receives a personal, private-use licence for the song: listening, playing at family and private events, sharing on personal social media. Any commercial use (advertising, synchronization, sale, monetization) requires prior written agreement. The Provider retains authorship rights and the right to present excerpts as a portfolio, unless the Client objects in writing.

8. Liability

The Provider is bound by a best-efforts obligation in artistic creation. The subjective nature of artistic appreciation cannot alone justify a refund, as the included revisions allow the work to be adjusted.

9. Mediation and disputes

In the event of a dispute, the Client first contacts the Provider to seek an amicable solution. Failing that, the Client may use a consumer mediator free of charge. French law applies.

10. Gift cards

A gift card entitles the holder to one personalized song of the plan shown on the card (Essential, Premium or Prestige). It is sold at the price of that plan on the date of purchase and sent by e-mail once PayPal has confirmed the payment. It is valid for 12 months from the date of purchase and can be used only once, with a personal code. Its value is deducted from the price of the chosen plan: the Client pays the difference and any add-ons. If the chosen plan costs less than the card, the difference is neither refunded nor carried over. The card cannot be exchanged for cash.

The buyer may exercise the right of withdrawal within 14 days of purchase, provided the card has not been used, by writing to contact@machansonperso.com. Once the validity period has expired, the card is lost. A song order placed with a gift card is subject to these terms, in particular article 6.
