Privacy policy

Your privacy matters, all the more so because you entrust me with personal stories to create your songs. This page explains what data is collected, why, and what your rights are, in compliance with the General Data Protection Regulation (GDPR).

Data collected

Through the contact form: name, e-mail address, phone (optional), occasion, song recipient, preferred musical style, delivery date, budget, and the text of your story. This data is provided voluntarily and is necessary to process your order and create your song.

For a gift card: the buyer's name and e-mail address, the first name and, if you provide it, the e-mail address of the person receiving the card, and the message you add. This data is used only to create and send the card, then to check its code when it is used. It is kept until the card expires (12 months), then archived for the legally required periods.

Purposes and legal bases

  • Processing your order and creating your song: pre-contractual and contractual measures.
  • Invoicing and accounting obligations: legal obligation.
  • Site audience measurement (if you accept it): consent.

Recipients

Your data is neither sold nor rented. It is accessible only to Jean-Luc Fernandez and, technically, to the site's hosting provider (Hostinger) as part of the operation of the service.

When you pay online, the payment is processed directly by PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A.). This site receives and keeps neither card numbers nor banking credentials: it only receives the payment confirmation, the amount, your name and your PayPal e-mail address. PayPal acts as the controller of your payment data under its own privacy policy. Loading the payment buttons may set PayPal cookies, which are necessary for the payment.

AI assistant

The site offers a conversational assistant based on artificial intelligence, to help you choose a plan or prepare your story. It only runs if you write to it. The messages you type (and the latest turns of the conversation) are sent for processing to Anthropic, PBC (United States), the processor that generates the reply. This site does not store them. Please do not enter sensitive data (health, opinions, bank details). The assistant can make mistakes: the reference information is the one on the Pricing page, the FAQ and the terms and conditions. Legal basis: your voluntary action (legitimate interest in answering your request).

Welcome code and occasion reminder

If you leave your e-mail address to receive a discount code or a reminder before an important date, I keep your address, the code given to you and, for a reminder, the occasion, its date and the first name you entered (optional). This data is used to send you the code, then the reminder at the planned time, and now and then the offers of Ma Chanson Perso (Christmas, Valentine's Day, Mother's and Father's Day). Legal basis: your consent, which you can withdraw at any time with the unsubscribe link in every e-mail, or by writing to me.

Addresses are also stored in the e-mail tool Brevo (Sendinblue SAS, France), a processor that hosts the data in the European Union. They are kept until you unsubscribe, and at most 3 years after your last exchange with Ma Chanson Perso.

Retention period

Unpaid orders are kept for 12 months. Data linked to an order is kept for the duration of the business relationship, then archived according to legal periods (10 years for accounting records).

Your rights

You have the right to access, rectify, erase, restrict, object to and port your data. To exercise these rights, write to contact@machansonperso.com. You may also lodge a complaint with the French supervisory authority, the CNIL (cnil.fr).

Security

The site is served over HTTPS. Form exchanges are protected and data is stored on servers located in the European Union.
